Denver marijuana panel backs $1 penalty on small amounts - The Denver Post

either though technically it'll still be $111.00 if it goes through.. which isn't that bad if you get caught...

My state if you get caught with anything less than an ounce = JAIL!!

Yea, maybe not the most but definitely on of the most decriminalized.

I have said it one more than one site, but less than a decade ago I read an article in the now defunct Rocky Mountain News (newpapaer) that Colorado had the highest per capita population of adult pot smokers. We are some fuggin stoners out here.

MMJ is blowing up out here. LLC's, dispenseries poping up everywhere, income taxes paid, etc.

I thought over 21 & possession of less than an ounce was already decriminalized in Denver. This was some time ago, no?

By approving the I-100, the use of marijuana in public, the use of marijuana by people under 21, driving under the influence of marijuana, and the cultivation and distribution of marijuana would all remain illegal, much like with alcohol.

It was about possession and use in private, ostensibly in one's home. Public use is still illegal, but again an ounce or less and it is a petty offense. Po-po takes your sack and gives you a ticket and says goodbye.

We're rollin' indeed. And Cat Jockey is trying to do his part.

While on the surface this seems good I am slowly coming around to the position that decriminalization is a bad idea:

1) The message that is being given out is that smoking mj is still a bad thing, just a less bad thing

2) It does nothing to address the fact that criminals will still be the main suppliers

3) It does nothing to address the rather dangerous and seedy conditions under which much the the stuff being sold and purchased

4) It sends a message to kids that our society's position on weed is much like the old Army idea of "Don't tell, don't know" (or however it used to be written) concerning gays. IOW - we are against it, it is bad, and we will still punish you if we catch you.. just less harshly than we did before.

My idea is simple - keep it illegal to buy and sell (except in authorized compassion clubs/clinics) but allow anyone to grow for their own personal use (and their friends of course!).

From the the bottom of my official Colorado Department of Health and Environment MMJ application:

WARNING! THE USE, POSSESSION, DISTRIBUTION AND MANUFACTURE OF MARIJUANA REMAINS A FEDERAL CRIME IN COLORADO, AND POSSESSION OF A REGISTRATION CARDPROVIDES NO PROTECTION WHATSOEVER AGAINST FEDERAL PROSECUTION.

That's encouraging. I am waiting for Governor to grab some balls and do what they can and are supposed to do to put an end to federal busts of legal MMJ grows. I am also waiting for the state of California to start taxing it. If California does that, no way in hell they are going to want to lose money from the feds busting 100,000 W grows.

It would no longer be Joe Schmoe v. The United States in the Supreme Court. It would be The State of California v. The United States.

The boys and girls in DC have taken the Interstate Commerce Clause way, way outside its original intention.

I understand your sentiment and agree with elements of it, but I think decriminalization a good thing. It is the only thing available to us and we must accept the reality of the situation that the easiest and most clear path to legalization is MMJ and decrimnalization.

Like I said, I certainly understand and don't wholly disagree, but it gets down to something my Dad told me when I was young and wishing for things:

Hold out both hands. Now, sh@t in one and wish in the other. Tell me which one fills up first.

We have to deal with what we got. The way the situation is today. One good thing that comes from decriminalization and MMJ is a reduction of the money going to really bad people south of the border. And north of the border. Seedy characters in Colorado are going to have competition from MMJ grows.

'Course, I am a bit seedy myself.

I agree it will always be bought and sold, but the question is under what conditions, regulations, laws, and penalties.

My problems with decriminalization are:

1) It is still illegal

2) It does nothing to change the attitude in the population as a whole

3) It does nothing to regulate growing, quality, distribution, of da herb. So, we will still have dealers trying to "hook" young children on the stuff.

4) As a law, it borders on the hypocritical.

I appreciate what you are saying about playing the had that has been dealt. However, I do not see decriminalization as a grand victory any more. At best it is a stop gap measure, at worst it opens up the door to a wide new range of problems for all concerned.

That is because the battle is not over yet smokey. It is a process. The wave continues. And I am a part of it. So is this site. How many states had MMJ 10 years ago? How 'bout today? People are selling weed and paying Federal Income Taxes. I can drive down to Denver and buy Crop Insurance in case of theft. MJ lawyers, accountants. Dispenseries where you can go walk in and buy a sack 'o weed. Legally - at least on the State level.

Don't give up. We must overgrow the 535 people in DC who have done this to us.

The more people like you, the less room for seedy characters.
