That sucks! I believe there has to be some sort of technicality though. I do not believe, unless you are to be arrested right there, that they can stop you from entering your own home for one. Do what the others suggested, write EVERYTHING down, and also another piece of paper write the questions you have about what they did. Believe me, ask questions and WONDER about it because you may find the angle you need that way.

Baloney. What State is that? In the Mountain Town (you know what I mean city ) word of mouth is absolutely enough for a warrant.

I bet it is in your lease on city fire inspections. Was it your Landlord detecting the 1000 watt drain and investigating????

How is the fire department allowed to just come in and do searches? Thats such BS. Sounds like someone had an idea of your grow and sent the Fire pricks in as a front, just to see what they could find. Totally sucks. I feel for you.

Well im surprised they didnt lock you up then and there. You're lucky. At least while you're free you can find yourself a good lawyer (im sure you dont need us to tell ya) Good luck and God bless.

Sorry man, that really stinks. Sounds like you had a small op, so you won't have to worry about MMS. If you cooperate you could walk away with probation, maybe home confinement for a little while. Like most states, FL has a pretty bad jail overcrowding problem, which can help keep non-violent offenders out of the clink. Sounds like you are getting treated easily. LEO has a lot of leeway in siezing assets - they could have taken alot more, inc. your PC

Definitely get a lawyer pronto, before they start dragging you in and questioning you. Once they arrest you they won't let you go until the questioning is over, and maybe until you are arraigned. Medical MJ defenses are working in some states - can you claim a medical need?

Expect the fines and fees to the courts- they will try to heap them on you. Your lawyer will be able to extend the duration of the payment, though - esp. if you don't earn much cash.

The courts will only be one source of aggravation. There's also the disruption to normal life. Make sure you're still going to have a place to live through all this (ie not get evicted) and keep your job.

This is #1 example for why folks should physically secure their grows, even in their own homes and regardless of if they rent or own. My grow is in a separate room with a locked door, different than the lock to the house. The veg cab also has a lock, and there's nothing MJ related hanging around the house - all the soil and pots and everything are out in the shed. Even if something looks or smells suspicious, the chance of getting busted is cut dramatically if its difficult to poke around.

I live alone but I still lock my grow. In one day on two separate occasions, friends came over uninvited and just walked into my house without calling first. They scared the hell out of me. Luckily I wasn't in the middle of doing a flush or moving plants or whatever. They'd have been cool even if they found out, but if a friend turns into an ex-friend the risk for bust goes up.

dayum thats ****ed up i would be pissed and probably wanted to beat the hell outta them for all that time into growing and money but to bad theres nothing you can do to them freaking cops i can imagine if that happed to me i would probably cry after it took me so long to start up my first plant.

just wondering, If the cops(or anyone) did in fact have an idea that you were growing and sent in the fire department to check it out, Is there anyway you could find out? Seems like a dirty thing to do.

Very likely true in the city but....City doesn't live in a big city. This is prob the biggest bust they have had all year.

He is looking at about 2-6 short months in the izzy jail. The guidelines are (0-6 months) for a first time offender. Believe me, there are WORSE jails than Izzy county which is full of white petty offenders and drunk indians.

With work release he might not even miss any time as school and can do a few months on his head.

But...I am more worried about financial aid, gettting kickd out of school and such. It just might be worth it to pay a high priced lawyer big bucks in the hopes of getting a diversion deal (never seen it on a cultivation case but just 4 f..ing plants in a closet!!!)

Odor is also enough "probable cause" in the state of Florida. Carbon Filtration is a must.

Now I don't know if they can legally come back and seize any other property.
But to be on the safe side, anything you have stored on your pc, I would erase it. Pic's, links, cookies, etc.
