What would have happened if the following would have happened:


1. You lived in a state where medical Marijuana is Legal and you had your State Card for Growth.

2. You had your bedroom door locked with a dead bolt, preventing the Fired DPT from entering???

Well the second one I can answer real fast, if you put your own deadbolt on most places that you rent, you will either get in trouble, or have to tell your landlord and give them a key.

BUT! At least when you got back, you'd know they tried to enter, and you'd have bought yourself some time to cover up the goods.

I doubt they'll evict them. Worst is "Take it off." Or "Key Please."

And then on reinspection... CLEAN.

Bummer City, it seems that someone has had their nose in your business even though you were keeping it out of site. If you know any of your neighbors maybe you could find out if any of them had a visit from the fire dept. or if you were pin pointed due to some suspicion.

Well I am on search for a lawyer today. In my lease it states that the firedepartment and cops may enter my premise at any time to do safety checks(no 24 hr buffer). The thing that really gets me is

I was building my grow box in the corner of my room(2ftx5x7, looked like a huge box(I told cops it was a box to keep all my sports memorbilia locked up and safe) and that is the reason the fire people were in my room, suposidly to see if that was a fire hazard. My closet is on the same wall as my door, so they would have had to walk into my room, turn around and NOT go back to the door, but go 3 feet to the left to look into my closet. It was open about a foot to let air in and out for the time being, but I had a 4ft board cover from the ground to 4ft. So they would have to look OVER the board to see the plants bearing below. They werre simply SNOOPING and I think I might be able to use that?

Man that sure sucks. while reading this it made me think of the patriot act where if they see something suspisious this means anyone I.E. Cable Guy Fire Dept. can narc you off and and its legitimate from what i've read with the patriot act if someone says something like that its considered proof enough for a warant. Still it sucks man Keep us posted.

Yes. If they went beyond the scope of a reasonable fire inspection then you win.

The good news is you have a case to supress the evidence and walk clean- and a MUCH better case to get a diversionary plea- which will save your federal financial aid in school.

The bad new is your attorney fee just went from $500.00 to at least $2,000.00.


BTW: Please read the lease if your going to grow folks.

Sorry to hear about your bust man. That would really piss me off to have something like that be the thing to undo a grow operation. Is there any chance you can make the legilization argument for weed and get the judge to overturn all the ridiculous laws prohibiting possession and cultivation?

The fire department did a routine inspection of my apartment last spring. The landlord gave me two weeks notice that it was coming up. I was here during the inspection, the fireman just tested my smoke alarm, poked his head into the bathroom, and left. They said the inspections happen every two years. I think this means I'm safe from this sort of thing during the upcoming fall and winter at least.

I can't believe there is no advance notice needed for a fire inspection. That is nutz. Just because it says that in the lease doesn't mean that it is the legal way to do it. I've signed "employee contracts" that aren't legally binding. Hopefully you get off ez. Make sure you get a differment! (<--sp?)

That's been my thinking when I've changed the locks everywhere I've lived, even when the lease said I wasn't supposed to. I put the old ones back before I move, and no property owner has ever seemed to notice. If they did, and wanted to evict me for it, it wouldn't be necessary because I'd move voluntarily from any place where people could just enter without notice.

I'm sorry this happened to you, City.
