i know what you mean years ago when i got a dui i had a small pipe with residue and no bud. i was charged with misdemeanor possession for the residue and a FELONY (possession of a tool to commit a crime) for the pipe. my court appointed attorney was suppossed to be 300 bucks! and she never knew who i was when i stopped by to see her. if you cant afford an attorney, even on a credit card, do as much research as you can about similar cases in your area. the law library ussually near the court house is very helpful. the ladies there helped me look up anything i wanted. take some cash to make copies so you can read up at home. i dont know what your personal situation is but if it was me only and now family here, i would make flyers with info from the norml.com website regarding jury decisions (you can vote not guilty even if the person is guilty just because you disagree with the law). i would make such a big deal in my area because the squeeky wheel gets the oil, and even if i lost i might get some media coverage about how ridiculous this is, and show some ppl why our jail are overflowing. I'm noisy and cant help it. i wish you luck, the best kind

Sorry to hear that it's dragging out. Guess they make you pay what you can afford.

Have you checked with NORML lawyers? Might also charge on an able to pay basis.

Stick with it...

...this too shall pass. Just think, in another six months you'll be kickin' back with a nice fatty once again. Just ride it out, bro- 'cause as bad as it seems- I promise, it's not really the end of the world. Though they sure'd like you to think it was...Hopefully we've all learned something from this experience. I know I have...growing in an apartment just isn't worth the risk!

The first laywer I went to was NORML and I was about this close to retaining him until he wanted damn near $4000 upfront to even talk to me. Man im paying for some schooling, cell phone, apartment, car crap I sure as hell dont have that laying around! CS

Because I was 20 when this happend, I do not apply for 74-11. My att. said I can apply and probably get some youthful trainee release. Its where I spend very little time in jail, maybe none because of my good background, but im on prohbation for atleast 2 years then whipped off my record. So he is waiving my pre exam and we are gonna try for this. Ill give you more details when I know people. Thanks for the support! CS

Not to worry

It seems to me that the firs inspector went beyond the scope of his inspection. They are allowed tocome and inspect but they are just sopposed to make sure that your somke detectors are in order. He really has no business going in a closet. That has nothing to do with his SAFETY INSPECTION. Thats what he is there to do. unless there were alot of newspapers or other fire hazzards in plane view I don't think he can go in your closet, without any smell, bad electric cords, something. I think a first year law student can win this one. Thats just my opinion. another thing; its clear that it was for personal use only. The charge should be a simple possession charge, not possession w/intent to sell. I don't think you will have any major problems. The worst case senerio if they want to be jerks is if you loose the illegal search issue you plead to a misdemeanor and get a suspended sentance or probation ar community service. A misdemeanor will not affect any student loans or any of that junk.

Well Im pissed and this is messed up so much. The only thing that came out good of this(besides them letting me keep all my fox farm ferts and stuff) I overheard them talking in my room, and I heard the female cop say, "He really knew what he was doing, he must have done this before"... and this was my first grow

Any advice? Im gonna get some kind of laywer right away here and maybe get help from there. Thanks, CS

well, actually, i copied part of this from the probable cause link in g.l.'s sig.

"II. Getting around probable cause:

Cops have all kinds of tricks to get around the warrant requirement:

the thing is, it's possible that they had a suspicion, but not enough pc to get a warrant.....hence the fire inspection.........
in any event, i hope that rational thinking and good karma rule this matter.
good grief, it's only grass........don't they have violent f**king offenders to deal with?

Angry sorry to hear about your bust

One thing about lawyers, they purposely keep getting continues on cases to get more money! When i had my dui one year, my dad told me, he was like all you have to do is apply for a drug/alcohol class and not need a lawyer. He helped me out and we got a lawyer anyway because we thought we had a case because the cops happend to drive back from another accident, they saw my car and me standing in my friends driveway. They didn't see me drive and my car wasn't damaged. I could have gotten away with it because it's not evading responsiblity unless theres damage, I messed up though because i told them i drove, my car hit ice and sild into a ditch in front of my friends house. Sure enough i got my case continued a few times before my lawyer said to the prosecutor my client will take the drug/alcohol program, was my first offense.

You say the fire department came into your apartment to make sure a box you had wasn't a fire hazard? How did they know about that box in the first place or did they happen to come into your apartment to look for things that could be a fire hazard? I'm confused on that! If someone has a box it doesn't mean it's a fire hazard, i'm guessing they are using it as an excuse, did someone set you up and report that your place was on fire? One thing that really sucks besides you gettin arrested is the fact that anyone else sees something they can report it to a cop making it easy for a warrant. You weren't even home at the time, for all they know someone broke in and put plants and a light in there and then set you up! Places like Canada would laugh over 3. I just hope they didn't weigh the soil, it's bad enough they assume all your plants would bud not knowing about males/females, goodluck with everything! Hearing about people getting busted over plants really pisses me off
