Well I cam home from work to find a cop standing at my front door of my apt. I walked up and he asked who I was and I told him, he then proceeded to tell me I was not allowed to enter my apt., and that a search warrent was on its way. Not 1 minute later another cop walked in with the warrent and I let them in. They sat me on the couch, and searched my room where in my closet was my little garden(1 plant 3 feet tall, 2 30 days into veg, and 1 baby 2 days new). They then proceeded to tell me that earlier that day, the firedepartment came to do an inspection on my place and found them then(TOTALLY PISSED ME OFF 100%) They quized me, and I kept quiet for the most part and very cooperative. They took out a digi snapped a bunch of pics then proceeded to rip my plants out of the pots, and through them in paper bags. They then unhung my 1000w hydrofarm setup and took that also(o yeah they took my stanley fan and the other little one) The SGT. said I cooperated so much he wouldnt take me in as long as I didnt flee the state and I agreed. He said in about a week he gaurenteed the prosicture would put a felony arrest warrent out for me, and Itd be in my best intrest to turn myself in asap. I dont know what to expect, this is my first ever offense of anykind so Im hoping I just get community service and pro, and I cant afford fines right now.

Well Im pissed and this is messed up so much. The only thing that came out good of this(besides them letting me keep all my fox farm ferts and stuff) I overheard them talking in my room, and I heard the female cop say, "He really knew what he was doing, he must have done this before"... and this was my first grow

Any advice? Im gonna get some kind of laywer right away here and maybe get help from there. Thanks, CS

Don't they need to let you know ahead of time that there will be "bla bla bla" entering your apartment to do "routine bla bla bla?"

i have heard here in bc that if you invite the police in and surrender your room that more than likely they will confiscate without reprimand.

but dont take my word for it.....no experience in that dept at all.

That is a bummer. Get yourself a lawyer, best you can afford, or a public defender. Say as little as possible about anything to the police especially w/o representation. Good luck.

Definitely get a good lawyer. In my state, FL, that would be a definite invasion of privacy, or possibly a misuse of information to obtain a warrant. They can't simply get a warrant based on word of mouth, regardless of who saw the **** (fire dept. included).

Did you see the warrant? Did they try to detain you at all? Did you LET THEM IN, or did they forcibly go in?

There's a lot you can do to possibly get out of all of this as long as you have a decent lawyer, depending on what state you live in. They need hard evidence to get a warrant, especially that quickly.

If all they had to obtain a warrant was word of mouth by the fire department, than it is all BS and would be thrown out in court IMO. It's a ****ed situation IMO, as cops will do everything in their power to make it look like they had a reason to initially enter the apartment.

I'm not sure there is much you can do right now, other than hope they give you the minimal charge/punishment. I was recently arrested on felony possession and because it was my first charge, I received an alternate sentence to a 6-week drug course which, upon completion, the charges were dropped. It all really depends on your judge, the state attorney (since it's a felony, they will be prosecuting), and your standing in life ATM. If you go to school or have a steady job and income, and are 'upstanding', etc, they will most likely let you off easy. If you work part time, don't pay child support, etc, you're going to spend a few nights in county lockup.

Just be happy they didn't take you in that day. That to me says they didn't have enough evidence to arrest you to begin with, and there's a lot that can be ought out by a lawyer in that situation.

Bottom line, get a lawyer. A good one. Usually the more they cost, the better they are.

You know, I've read about a bust made on this family becasue their electricity was so high. Turns out, is was a single mother of 3, with washer, dryer, dishwasher, 3 computers 3 tvs, and AC running. Go Figure.

I just thought of something the cop told you you couldn't enter your own apartment even before you were served with a warrant which sounds like the technacality you may be looking for I think It would be in your best interest to write down everything that happened word for word and event for event that way you will have it documented while it is fresh in your mind It help the lawyer you end up with, with precise info, not info remembered a week or two or a month after the fact.

Sorry to hear about your grow.

Take anything said here with a grain of salt. An attorney needs to be seen as you have said. They will be able to talk you through the options open to you.

In some leases it is stated that periodic inspections will be made. A gander at your lease will tell you if that provision was included when you signed it.

Hope they slap you on the wrist. Nice of them to compliment your growing skills though.
