Is it considerd invasion of privacy if a police helicopter flys over your house and see's your plants. Im not sure they saw them or not, they were going a decent speed. But it was DIRECTLY over my house. 10 mins after i justfinished putting them in larger more noticable pots too. X( . I think i might just put them off the property... but they wont get as much light off the deck.

The town i live in must has allot of growers, and im sure much larger grows could be spoted easy. I would think the cops out here wouldnt care about 10-15 plants.

But my main question is that, would they still have to get a warrant to come on my property/how easy is\long is it for them to obtain one?


If they do charge up here without a warrant, ill be sure to have my recorder recording in my back pocket. And to ask them in a legal yet suttely unnoticable way if they wouldnt mind being recorded.

As to your other questions, no, they don't need a warrant to look out the window of their chopper; obviously, they don't need a warrant, if you're going to let them bluff their way in; and getting a warrant is as easy as lying to a judge.

The title of this thread is "question for a law expert". You dont sound like a law expert to me. Your information seems like assumptions. Is there anyone who has read a law book/been to law school and knows the written words in there law books that they use as a weapon to do their job. If i had these law's memorized, theres nothing they can say or do against it. It would be a egotic psycological battle from that point on. Somthing I would look foward to if i had the their tool of imaginary birthrights they have created to defend their (and assumptions of our) fears; (these are apparently protecting us from somthing...¿?) From my experiences, all it seems these cops want is self gratification. Either from being currupt and powerful. Or from a christian like delusion of what they think is right. ... Yea i better stop right there. I could go on and on about how inefficent and impractical these "authoritys" are. As could any sane person aware of these daily wars.

sorry, im no law expert, but im in real estate and in one of my classes they taught us that you own the land, above (the air) and below the surface. i specfically remember the instructor sayin u own all the way up to space, vice versa. So IMO, it should damned well be invasion of privacy, but it seems like it dont matter anymore. cops suck.

as for law expert, there used to be a lawyer or 2 on here, but I think they quit posting for some reason, hope u hear from one

Edit: I just found my ol text and reviewed, specific mention about your air rights is that government controls air space, and owners may not interfere. need law expert for sure

so yes it was an assumption that wasnt based on legal knowledge but one of that that was hear say

further more - how many times have you been pulled over for some rediculious excuse - they want a reason they will make one up

i was driving on interstate one night and got pulled over randomly for a spot drug test at 2am

they asked if they could search my car - i said sure go ahead - cuz i had nothing to hide

i went on to ask the cop what if i said no

he said he would have just kept me here until either they faxed him a warrant to his car or a dog showed up and gave him cause

maybe he wasnt legal to do so but i found it to be interesting

so my assumtion was based on some small expeience - not on expert legal advice

and again an assumtion in it self states that your not sure- but instead you are guessing base on samll info that you have

Dude, I live by an airport. I see flying pigs DAILY. I dont sweat it until ones landing in the field and approaching my spot, which has happened once a few years ago with a 6 1/2 foot pink haired hybrid MONSTER who was just about 3 weeks until harvesting. It was on nearby abandoned property.

I step out my back door at about 3 AM with a backpack full of spring water jugs mixed with bloom plus and I actually saw them taking off from the field so I stayed away from the spot but observed no traffic in or out for like 3 weeks and FINALLY couldnt take it anymore and just had to go see what was going on - hoping against all odds there would be this beautiful gigantic stick of bud waiting for ME to cut her down, but no...they beat me to it and probably smoked my pot and laughed about how good it was the whole way back to HQ.. F**k em y'know?

they don't need a warrant if they have probable cause and suspect a law is being broken

if you are standing on your property smoking a joint and they can SEE you, they have probable cause.

If your plants are sitting where anyone can see them, they have probable cause.

They cannot enter your house, but if they can look over your fence (like a meter reader) and see your plants, they have probable cause.

and lastly....although FLIR (foward looking infra-red)imaging devices are an invasion of the interior of you home, merely looking down onto your property from a helicopter is NOT a protected space

I assume you DO have a fence.
If not, the courts see it as you never HAD an xpectation of privacy.
