Smell is definitely probable cause to search a car in California. A possession charge and $200 later, I have no doubts about that one.

You have enough smoke to set off a smoke detector? Sheesh, I can smoke Js or cigarettes under mine. There was one too close to the kitchen though...

check the NORML website , they have the most current info on MJ laws , at least to my understanding.
If nothing else do a websearch for cannabis laws in your state. If it's a state law then it has to be published someplace.

Can I ask what state you live in?Is it no tolerance for MJ there? Cops cant kick down your door unless their in pursuit or have a warrant.

I wish I could find the post but on the other site, years ago, there was an article that stated that the US supreme court ruled that smell/odor was not probably cause. The case that helped determine that was of people smoking in a car. Maybe it was overturned but if not then odor does not give them probable cause.

I read this as well. I think it was on this site somewhere?

There isn't really any need to be paranoid but then again I'm not aware of the laws over in the US but over here in the UK you are permitted to smoke as much pot as you want, inside your house that is and only inside your house where it's 'personal'.

The Police can walk in any day and like the smell of your bud to be in one of your evidence pouches but that isn't going to happen because your smoking your weed personally, behind closed doors, and they cannot build up ANY kind of suspicion unless theres alot of traffic in and out from your house and your dealing, otherwise, your good.

On the other hand if you get the 'bad cop' knocking at your door asking about the sweet aroma of God's Gracious Green, tell him to knock on someone else's door;
" I'm stressed, depressed and tired, waiting to go back to work, and I've broken my ankle/hand/neck, upon visiting the doctors they asked me if I wanted to prescribe anything and I declined but asked them whether I would be able to smoke marijuana to cease the pain, and I smoke the weed to myself, I'm not doing anything wrong and you just 'happened' to knock on my door when I'm not the only one having a nice big fat blunt to myself, check the rest of the world out, bye bye! "

And it is really as simple as that, they can bust you when your only doing something wrong like distributing to others or advertising it too much, so make sure you don't keep your windows open completely, have some ventilation but don't be expecting your neighbours to photo-frame you, unless your in the nick that is.

Phewwww, glad I could say that to someone.

Well... cars are different from houses. In a house they need a warrant, in a car things are a bit different. It doesn't take much (i.e. probable cause) for a full search of the car to be done.

It was only a misdemeanor (or infraction? I don't remember), and no court date was necessary if I paid the ticket. So my decision was $200 or pay a lawyer more and still lose b/c I was wrong in the eyes of the law anyways... Gotta pick your battles. I'll fight a cultivation charge regardless but a misdemeanor... forget it.
