This link has detailed definitions of personal protection and self defense. From what i gathered from it in the read its pretty simply stated that the only situation in which you are permitted to use deadly force is a situation in which you are being threatened with deadly force. I might add.. there is one hitch to the whole thing (and this came from my electrician brother in law that USED to be a local cop). You are allowed to use deadly force in a situation when the threat cannot be determined. I.E. if you are in a dark home and cannot tell if an intruder is armed or not and they APPEAR that they may be. In which case.. Here's a tip: Always keep a few potted plants available to put in your room if the need arises (ornamental flowers or potted vegetables like tomatoes would work best). There is no law against indoor gardening, and having and using the gear in itself isn't a crime. The only crime is what's grown with said lights. If you ditch the plants (one should always have an emergency plan to ditch plants at a moment's notice - as well as the willingness to do it) and put a few orchids or any other plant (orchids are good though: light, very portable, not expensive, good looking, and many people grow them indoors) in the room. I would think that taking the time to take apart a grow room (which may take a lot of time if you have elaborate hydro setups/many plants or lights/ventilation/grow tents/etc) before calling LEO about a guy you just killed for breaking in your house would be a horrible move. I know that it would take me well over an hour (perhaps 2) to break down my grow setup to where it leaves minimal trace, and even then there are holes in walls etc that can't be hidden. And that's only if you have a place to stash your gear off premises. And all that with a dead guy in your house who's blood is drying/other death related issues to explain later on. Just quickly replace the plants with decoys and call LEO. Quick and easy. Who's to say that the dead guy in your house was there to steal weed? | |||

With that though comes some rules, these have to do with the right to use deadly force on your property. In CA the entry has to be both forceful and unlawful for you to use deadly force. So if you leave your front door unlocked and some drunk stumbles in you can't shot that person. If someone breaks a window and come in you can shot them on site no questions asked. But you can't shot someone in the back as they flee your property, even if they have stolen from you. In that case the court will say that they no longer posed a theat to you so you don't really have a reason to take their life. This law has many grey areas, and even each state has different guidelines for using deadly force on someone breaking into your house. You really should contact an attorney in your state, or look it up online to see where your state sits.
