| Ok, I dunno if this is legit in this forum but it is a question about cops and such. OK, say you were in your car(you driven) and a cop pulls you over. You have been smokin(not necesssarily in the car)but your eyes are red. Most likely he'll ask you to step out and ask you a few questions, but at this point...would he have the right to search your car? I mean would you be ok, if you convinced him that you had allergies or somethin.lol, even if you had a sac in the car? he woulden't have the right to search your car would he??? Please answer this, cause I need to know, now that I got a car. Thanx ![]() | ||

![]() | Take a look at the Protecting Your Rights forum. They can't search your car unless you give them permission or they have a warrant or reasonable cause. In any case, never give permission (even if you don't have anything in your car). If they search you, repeat over and over loudly and clearly that you don't consent to the search. Its a 4th Ammendment right. Unfortunately, they can still bring drug dogs on but if they policeman tries to stop you if they're going to give you a ticket or something let them, but after they're done tell them you're in a hurry and you really have to go if they ask anything else. They can't keep you there unless you're under arrest or otherwise detained (unless you consent). Hope I helped. [This message has been edited by 420forever (edited July 11, 2000).]

| The only way a cop can do a legit search of your car is if thge cop sees something in plain view , or you agree to it. Rolling Papers, a empty baggie, a bong left out in the open ends up more questions being asked. If the cops says he saw you smoking or smells weed you're done until you get a laywer. My advice is just smile and ask if you're being arrested. If you are just go along and say nothing. If you are not being arrested just ask for you ticket and exspress a need to vomit, piss, or you have exsplosive diareah. DO you best to prove to the cop that in fact if you don't leave soon it's gonna be very messy. No Cop will arrest anyone with a mess in their pants or want to clean up the back seat of the doughnut mobile. [This message has been edited by Joker1.5 (edited July 11, 2000).] | ||

| but 420 girl, woulden't red eyes be considered reasonable cause? Thats why I mentioned that, oh and they can bring dogs? wtf! Isen't that defying the whole purpose of not invading privacy, by not searching? Cops can't search, but dogs can...thats bull****! I hate the law!! | ||

![]() | I don't think red eyes would be reasonable cause, because there's a million causes for red eyes...allergies, contact lenses, etc...but if the cop says that you smell like weed then they can search you...but with red eyes only no. Some police might make something up if they want to search you or something (not all), so you might wanna put eye drops (Visine, Clear eyes, etc.) in, or not drive high (which is best I think!).
