Saw this in the local paper last week, haven't seen anyone broach the subject here so I thought I'd share it with the community. The link to the news story is HERE But if it's a violation to post the link like I just did, here's a cut and paste of the article. Pot grower faces murder charges for firefighter deaths PHILADELPHIA, Pennsylvania (AP) -- A house blaze that killed two firefighters started in a tangle of wires and lamps that were installed to grow marijuana in a basement closet, authorities said. The man who police say was responsible for the drug operation was charged with third-degree murder. Fire Capt. John Taylor, 53, and firefighter Rey Rubio, 42, died Friday when they were trapped by quick-moving flames while trying to find the source of the fire. Fire officials said the fire started in the wiring set up to run the lamps and fans used to nurture the plants, and spread more quickly because the hot lights had dried out the wood in the closet. In addition to murder, Daniel Brough, 35, faces charges of marijuana possession, involuntary manslaughter and causing a catastrophe. Philadelphia District Attorney Lynne Abraham called Brough "reckless," "foolish" and "greedy." Taylor, a 32-year veteran of the department, and Rubio, who had been fighting fires for 12 years, appeared to have died of smoke inhalation, officials said. Can't believe the writer of this story used that last line to end the article ...

This would be really funny if it wasn't true. Doesn't murder typically involve premeditation of some kind? Didn't the Firefighter choose to go into a burning building, and isn't risking life & limb kinda part of the territory? Aren't they trained handle those type of situations? In fact, I think they might have better luck charging the flames with murder, or better yet- the idiot who sent them into the building in the first place. Oh wait, I forgot...nobody forces them to do it. I don't mean to sound callous....merely...I can see if it was arson, or if the guy had set bear traps or pungy sticks that immobilized the firefighters, but for gods sake...this is absolutely asinine. I guess it's kinda in the American genome now though- a nation where complete stupidity seems to make the pain of senseless tragedy a little less painful....yeesh, I think we could all use a nice fatty. What's the legal precedent for murder charges involving bad wiring, anyway? I guess electricians'll have to start carrying the same insurance doctors do.... Excuse me...I think I'm gonna go be sick now.

God rest the souls of the firefighters, but this guy shouldnt be charged with murder. These people want revenge for their buddies deaths, thats all it is. If this guy were growing tomatoes in his closet and the same thing occured, they wouldnt slap him with murder charges. I think this guy should avoid all deals thrown to him by local D.A.'s and take this to trial, no jury in the world is gonna convict him. (unless they're anti-pot fanatics or something) Trully a tragedy, but clearly an accident.

i agree that is a trumped up charge. what a f*d up situation. the lesson here is dont mess around with bad electricity. make sure your grow is safe and secure, for legal reasons and life and health reasons.

| jayv25 you have more faith in a jury of your peers than I do. This just underlines the importance of safety in your grow space. Wireing up too code, proper ventilation, air space arount hot lights, smoke detectors, fire extinguisher, etc. Somethings in life have to be taken very seriously.

These people want revenge for their buddies deaths, thats all it is. /QUOTE] well jay unfortunately i disagree you with you and probally most people on these board...the jakes were doing there their job and they die... this grower was irresponsible and stupid for running that type of setup....he will probally end up being charged with manslaughter, not murder manslaughter n. the unlawful killing of another person without premeditation or so-called "malice aforethought" (an evil intent prior to the killing). It is distinguished from murder (which brings greater penalties) by lack of any prior intention to kill anyone or create a deadly situation this grower with the dangerous setup causesd the death of those two firefighter and should be punished for it... irresponsilbe growers in general give us all a bad name and every incident like this is a setback to legalization i have my cabinets running off 2 dedicated 15 amp circuits with smoke detectors installed and fire exstinguisher handy.... | ||
